1. Introduction and Scope

1.1. This Shipping and Delivery Policy ("Policy") is issued by Mithila Hosieries, having its principal place of business at 46.A(6) Kumaran Colony Extension, Rakkiyapalayam Road, Ammapalayam, Tiruppur, Tamil Nadu 641652, India ("Company", "we", "us" or "our").

1.2. This Policy governs the dispatch, carriage and delivery of Goods purchased through the online store operated at www.mithilahosieries.in ("Platform"). It forms an integral part of the Terms and Conditions of the Platform and shall be read together with the Refund, Return and Cancellation Policy.

1.3. Capitalised terms used but not defined in this Policy shall carry the meaning assigned to them in the Refund, Return and Cancellation Policy.

2. Definitions

2.1. "Business Day" means any day from Monday to Saturday, excluding public holidays notified in the State of Tamil Nadu.

2.2. "Consignment" means the parcel in which the Goods are carried to the delivery address.

2.3. "Courier Partner" means the logistics service provider engaged by the Company for carriage of a Consignment.

2.4. "Dispatch" means the handing over of a Consignment to the Courier Partner.

3. Territory of Delivery

3.1. The Company delivers Goods to addresses situated within the territory of India and served by its Courier Partners. The Company does not presently effect delivery to any destination outside India.

3.2. Serviceability is verified against the postal code furnished by the Customer at checkout. Where a postal code is not serviceable, the Customer shall be so informed before payment is authorised.

3.3. Where a postal code is accepted at checkout but is subsequently declined by the Courier Partner, the Company shall cancel the order and refund all sums paid by the Customer in full, including any COD Advance, in accordance with the Refund, Return and Cancellation Policy.

4. Shipping Charges

4.1. Shipping is charged at a flat rate determined by reference to the weight of the order. No separate handling or packing charge is levied, and the rate does not vary with the distance of carriage.

4.2. The applicable rates are as follows:

4.3. The shipping charge applicable to an order shall be computed and displayed in the shopping cart and again at checkout before payment is authorised. The sum so displayed shall be the sum payable, and no further charge shall be levied after the order has been placed.

4.4. Where the Courier Partner assesses carriage by reference to volumetric weight, any excess over the rates in Clause 4.2 shall be borne by the Company. The Customer shall be charged solely by reference to the slabs specified in Clause 4.2.

5. Dispatch and Delivery Periods

5.1. The indicative periods for dispatch and delivery are as follows:

5.2. Orders placed after 4:00 p.m. Indian Standard Time, or on a Sunday or a public holiday, shall be taken up for processing on the next following Business Day.

5.3. The periods specified in Clause 5.1 are estimates furnished by the Courier Partners and do not constitute a guarantee of delivery by any particular date. Delivery periods may be extended during festival seasons, monsoon disruption, industrial action or comparable conditions.

5.4. The Company shall not be liable for any delay or failure in delivery occasioned by any cause beyond its reasonable control, including act of God, flood, fire, epidemic, industrial action, civil commotion, act of government, failure of the Courier Partner, or failure of telecommunications or power infrastructure. The Company shall in such event keep the Customer informed and shall assist in pursuing the matter with the Courier Partner.

6. Tracking

6.1. Upon Dispatch, the Company shall communicate to the Customer, by electronic mail and by short message service or messaging platform, the tracking number of the Consignment together with a tracking link.

6.2. Tracking information ordinarily commences to reflect movement within twenty four hours of Dispatch. Where tracking information has not been updated for a period of three days or more, the Customer may notify the Company, whereupon the Company shall take up the matter with the Courier Partner.

7. Cash on Delivery

7.1. The cash on delivery facility is available in respect of eligible orders and serviceable postal codes, at the discretion of the Company. An order placed under this facility requires payment of the COD Advance online at checkout, the balance being payable in cash to the Courier Partner upon delivery.

7.2. The COD Advance represents a charge in respect of costs irrevocably committed by the Company upon Dispatch of a cash on delivery Consignment, namely forward carriage, return carriage in the event the Consignment is returned, and payment processing, packing and handling. A Consignment that is refused occasions carriage in both directions together with handling, whether or not the Customer at any time intended to accept it.

7.3. The amount of the COD Advance is determined by reference to the weight of the order and shall be displayed at checkout before payment is authorised. The COD Advance is presently levied at the following rates:

7.4. The COD Advance shall be adjusted against the total value of the order. The Customer shall pay only the balance upon delivery, and an order placed under the cash on delivery facility shall not in any event cost more than the price displayed on the Platform together with the applicable shipping charge.

7.5. The Customer shall tender the balance sum in exact cash. Courier Partners are frequently unable to furnish change, and a delivery that fails for want of exact cash shall constitute a failed delivery for the purposes of Clause 8.

7.6. The circumstances in which the COD Advance is retained by the Company and those in which it is refunded are set out in Clause 7 of the Refund, Return and Cancellation Policy. In summary, the COD Advance is retained where delivery fails for a cause attributable to the Customer and is refunded in full where delivery fails for a cause attributable to the Company or to the Courier Partner.

7.7. The Company may decline the cash on delivery facility in respect of orders of high value, postal codes exhibiting an adverse delivery record, or a delivery address or telephone number in respect of which refused Consignments have previously been recorded. Prepayment shall remain available in every such case.

8. Delivery Attempts and Failed Delivery

8.1. The Courier Partner shall make up to three attempts at delivery and shall ordinarily place a telephone call to the number recorded on the order before each attempt.

8.2. In order to avoid a failed delivery, the Customer shall furnish a complete delivery address including landmark, floor and unit number, and a telephone number at which the Customer may be contacted. Failure to answer the call of the Courier Partner is the most frequent cause of failed delivery.

8.3. Where three attempts at delivery have failed, the Consignment shall be returned to the Company. In the case of a prepaid order, the Company shall refund the value of the Goods upon receipt of the Consignment, less carriage already incurred. In the case of an order placed under the cash on delivery facility, Clause 7.6 shall apply.

9. Receipt of the Consignment

9.1. The Customer shall examine the outer packaging of the Consignment before accepting delivery. Where the outer packaging is torn, wet, resealed or otherwise visibly tampered with, the Customer should decline to accept the Consignment and notify the Company on the same day.

9.2. Where the Customer accepts the Consignment and thereafter discovers a defect or discrepancy, the Customer shall notify the Company within seven days of delivery, furnishing photographs of the Goods and of the shipping label, in accordance with Clause 5 of the Refund, Return and Cancellation Policy.

9.3. Risk in the Goods shall pass to the Customer upon delivery. Title in the Goods shall pass upon receipt by the Company of payment in full.

10. Part Shipment

10.1. Where an order comprises Goods that cannot conveniently be carried in a single Consignment, the Company may divide the order into two or more Consignments. No additional shipping charge shall be levied in respect of a division effected at the instance of the Company, and each Consignment shall bear its own tracking number.

11. Alteration of the Delivery Address

11.1. The delivery address may be altered only before Dispatch. A request for alteration shall be communicated to the Company without delay, quoting the order number.

11.2. After Dispatch, the delivery address is fixed and cannot be altered by the Company. The Courier Partner may, at its discretion, permit the Customer to reschedule the date of delivery through the tracking facility.

12.2. Every communication shall quote the order number. The Company shall respond within two Business Days.

13. Amendment and Governing Law

13.1. The Company may amend this Policy from time to time. The version of this Policy published on the Platform at the time an order is placed shall govern that order.

13.2. This Policy is governed by and construed in accordance with the laws of India. Subject to the rights conferred upon consumers under the Consumer Protection Act, 2019, the courts at Tiruppur, Tamil Nadu shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with this Policy.
